Klimate Terms of Use
Effective: August 1, 2026
These Terms of Use apply to Klimate, a weather application operated by Kraig Spear in Michigan, United States. By using Klimate after these Terms become effective, you agree to them. If you do not agree, do not use the application.
Weather Information Is Informational
Klimate presents weather forecasts, environmental conditions, alerts, radar, and related information from third-party providers. Weather conditions can change quickly, and provider data can be delayed, incomplete, unavailable, or inaccurate. Klimate does not guarantee that any forecast, alert, air-quality value, pollen value, radar image, or recommendation is complete, current, or error-free.
Klimate is not an emergency-warning service. Do not rely on it as your only source for severe weather, evacuation, travel, aviation, maritime, medical, public-health, or personal-safety decisions. Follow instructions from government authorities and qualified professionals.
Activity Guidance
Klimate can help you describe preferred weather conditions and compare them with forecast data. Criteria drafted with Apple Foundation Models and any resulting activity guidance are automated, informational suggestions. Review them before use and apply your own judgment. They are not medical, safety, legal, or professional advice.
Third-Party Services and Data
Klimate depends on services and data that may include Apple Core Location, MapKit, WeatherKit, CloudKit, Foundation Models and Private Cloud Compute; Cloudflare; Google Pollen and Air Quality; NOAA and the National Weather Service; radar providers; and TelemetryDeck when optional analytics are enabled. Those providers may change, restrict, suspend, or discontinue their services.
Google environmental information is subject to the Google Maps Platform Terms of Service and Google Privacy Policy. Apple services are subject to Apple’s applicable terms and policies. Provider names and marks belong to their respective owners.
Your Responsibilities
You are responsible for your use of Klimate and for decisions based on information it displays. You agree not to misuse the app, interfere with its operation, attempt unauthorized access to its services, evade technical limits, or use it in violation of applicable law or third-party rights.
Availability and Changes
Klimate may add, change, suspend, or remove features. Service interruptions can occur because of maintenance, network failures, provider outages, operating-system changes, or circumstances beyond Klimate’s control. There is no guarantee that every feature will be available in every location, on every device, or at every time.
Disclaimer
To the extent permitted by law, Klimate is provided “as is” and “as available,” without warranties of merchantability, fitness for a particular purpose, noninfringement, accuracy, availability, or reliability. Some jurisdictions do not allow certain warranty exclusions, so part of this section may not apply to you.
Limitation of Liability
To the extent permitted by law, Kraig Spear will not be liable for indirect, incidental, special, consequential, or punitive damages, or for losses resulting from reliance on weather information, activity guidance, third-party data, service interruption, or loss of data. Nothing in these Terms excludes liability that cannot lawfully be excluded.
Governing Law
These Terms are governed by the laws of the State of Michigan and applicable United States law, without regard to conflict-of-law rules, except where consumer law requires otherwise.
Changes to These Terms
These Terms may be updated to reflect changes to Klimate, its providers, or applicable requirements. The revised Terms will be published with an updated effective date. Material changes will receive additional notice when appropriate.
